----- Conditions of Hire -----
Mr and Mrs OP Digney, the owners, shall be under no liability to any person or member of a holiday booking for any personal injury, loss or damage to property however sustained or caused damage for the loss or theft of property and/or money.
The owners undertake to keep the property and all furniture, fittings and effects in or at the property in good and tenantable condition.
The hirer undertakes to keep the property and all furniture, fittings and effects in or at the property in the same state of cleanliness repair and condition as at the commencement of the hire period, (reasonable wear and tear excepted).
The owner gives all information and makes all statements in good faith and checks so far as is reasonable all the information given to applicants. The owner shall not be liable for any loss or damage resulting from the information given or statements made whether orally or in writing.
The hirer signing the Booking form is and will remain responsible for the members of his/her party and agrees to ensure that they are aware of the Conditions of Hire and that they meet their obligations arising from them in every way.
The hirer failing at any time before or during the hire period to meet his/her obligations shall be deemed to have cancelled his contract with the owner who may seek to repossess the property.
The owner will accept reservations only on receipt of a completed Booking form from the hirer upon payment of a deposit of 25% of the total hire charge.
Upon payment of the deposit and subject to the acceptance of the booking the hirer becomes liable for the balance of the hire charge for the full period of hire.
The balance of the hire charge is due for payment 28 days before the hirer's arrival. Non payment of the balance by the due date shall be deemed to be a cancellation of the arrangements of the hirer.
Under no circumstances may more than the maximum number of persons as stated in the Brochure occupy a flat except by prior written agreement with the owner.
For any booking made within 28 days of the hirer's proposed date of arrival the full hire charge shall become payable with the hirer's reservation on the booking form.
The hirer remains liable for the full balance of the hire charge.
However, the owner will do all he reasonably can to re-let the accommodation following a cancellation and if successful will refund such part of the deposit and/or balance as remains after deduction of any additional expenses incurred.
Regrettably, pets cannot be accommodated.
The hirer undertakes to report all breakages or damage as soon as reasonably possible after its occurrence so it can be replaced or repaired for the convenience of the hirer and subsequent holiday makers.
Minor damage or breakages will not normally be charged to the hirer but all damages and breakages are the legal responsibility of the hirer and their cost shall be refundable on demand.
Many of the breakable fixtures are covered by insurance and repair of accidental damage to them would not therefore be charged to hirer.
Rights reserved by the owner
The owner reserves the right to decline accommodation.
The owner reserves the right of entry to the property at all reasonable times with or without workmen for the purpose of inspection or to carry out any repair deemed necessary to the property or equipment including gardening.
Security of tenure
The flats are used as holiday accommodation and therefore exempt from security of tenure under the Rent Act.
